1. Agreement to Terms
By accessing or using the Capacitor platform ("Service"), operated by T8 Labs Ltd ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
The Service provides an OCPP 1.6J API platform that enables developers to integrate with electric vehicle (EV) charging stations. The Service is a software intermediary only and does not manufacture, install, maintain, or operate any charging hardware.
2. Eligibility
You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the organisation you represent. By creating an account, you represent that you meet these requirements.
3. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and API keys. You are responsible for all activity under your account.
You must notify us immediately at hello@capacitor.live if you suspect any unauthorised use of your account or API keys.
4. Subscription and Billing
The Service offers tiered subscription plans (Free, Starter, Growth, Scale) with varying usage limits, features, and pricing as described on our website. Paid subscriptions are billed monthly via Stripe.
- Subscriptions renew automatically each month unless cancelled before the end of the current billing period.
- Cancellations take effect at the end of the current paid period. No partial refunds are provided for unused time.
- We reserve the right to change pricing with 30 days' notice. Price changes do not affect current billing periods.
- Exceeding usage limits (API calls, charger count) may result in rate-limiting or temporary restriction until the next billing cycle or an upgrade.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable laws.
- Attempt to gain unauthorised access to the Service, other accounts, or connected systems.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service to transmit malware, spam, or other harmful content.
- Circumvent rate limits, authentication mechanisms, or usage restrictions.
- Resell or redistribute access to the Service without our prior written consent.
- Use the Service in any manner that could damage, disable, or impair the Service.
6. API Keys and Security
API keys provide programmatic access to the Service. You are solely responsible for keeping your API keys confidential and secure. Do not embed API keys in client-side code, public repositories, or otherwise expose them.
We may revoke or rotate API keys at any time if we suspect misuse or a security breach. You should revoke compromised keys immediately via the dashboard or API.
7. Limitation of Liability — Charging Hardware
THIS IS AN IMPORTANT PROVISION. PLEASE READ CAREFULLY.
The Service is a software platform that relays OCPP messages between your application and EV charging stations. The Company does not manufacture, install, own, operate, maintain, inspect, or control any EV charging hardware.
You acknowledge and agree that:
- No hardware responsibility: The Company has no responsibility whatsoever for the physical condition, safety, installation, maintenance, or operation of any EV charger connected to the Service.
- No safety guarantees: The Company makes no representations regarding the safety, reliability, or fitness of any charger hardware. You and/or the charger operator are solely responsible for ensuring compliance with all applicable electrical, safety, and regulatory standards.
- No liability for hardware failures: The Company shall not be liable for any damage, injury, loss, or claim arising from charger malfunction, electrical faults, fire, overcharging, hardware defects, installation errors, or any other issue related to the physical charging equipment.
- No liability for charging outcomes: The Company shall not be liable for any damage to vehicles, batteries, property, or persons arising from charging sessions initiated, managed, or monitored through the Service. The decision to start, stop, or modify a charging session is made by you or your application.
- Indemnification: You agree to indemnify and hold the Company harmless from any claims, damages, losses, or expenses (including legal fees) arising from the use or operation of any charging hardware connected to the Service.
8. General Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
THE COMPANY'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (£100).
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee any specific uptime or availability.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may suspend or restrict access to the Service for maintenance, updates, security incidents, or other operational reasons. We will endeavour to provide reasonable notice for planned maintenance.
11. Intellectual Property
The Service, including its software, APIs, documentation, and branding, is owned by the Company and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.
You retain ownership of your data and any applications you build using the Service.
12. Data and Webhooks
You are responsible for the data you transmit through the Service. When configuring webhooks, you are responsible for securing your webhook endpoints and handling received data appropriately.
We may retain operational logs and metadata for debugging, security, and service improvement purposes, as described in our Privacy Policy.
13. Termination
You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms or for any other reason with reasonable notice.
Upon termination, your access to the Service will cease. We may delete your data after a reasonable retention period unless required by law to retain it.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
